Agreement
These Terms of Use ("Terms") govern your use of theultimatebrew.com (the "Site"), operated by Ultimate Brew, LLC ("The Ultimate Brew", "we", "us"). By using the Site or joining our list you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
What the Site is for
The Site presents The Ultimate Brew coffee, publishes our third-party laboratory results, helps you find the coffee at Sprouts Farmers Market, and lets you sign up for updates. The Site does not sell products directly at this time. Product availability, pricing and purchase terms at Sprouts or any other retailer are set by that retailer.
Product information and testing results
We publish laboratory results for representative samples of each lot as reported by an independent third-party laboratory. "Not detected" means the substance was not detected above the laboratory's limit of quantification for that method; it does not mean zero. Results describe the tested lot and do not guarantee any other lot, batch or product. Nothing on the Site is medical, nutritional or health advice, and no statement on the Site has been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure or prevent any disease. Consult a qualified professional with questions about your diet or health.
Email and text list
When you join our list you agree to receive marketing emails and, if you opt in with your mobile number, recurring automated marketing text messages. Consent to texts is not a condition of purchase. Message frequency varies; message and data rates may apply. Reply STOP to cancel or HELP for help. You confirm you are the subscriber or customary user of the number you provide and will tell us if it changes. Full program terms are in the SMS section of our Privacy Policy.
Acceptable use
- Do not misuse the Site, interfere with its operation, or attempt to access it by means other than the interface we provide.
- Do not copy, scrape, frame or republish the Site or its content, other than for personal, non-commercial reference.
- Do not submit information that is false, misleading or belongs to someone else without their permission.
Intellectual property
The Site and everything on it, including the name The Ultimate Brew, the logos, packaging designs, photographs, renders, films, text and layout, are owned by Ultimate Brew, LLC or its licensors and protected by copyright, trademark and other laws. Sprouts and the Sprouts Farmers Market logo are trademarks of their owner and are used only to indicate where the product is sold. You receive no license to our marks or content beyond viewing the Site.
Third-party links and services
The Site links to third parties such as Sprouts Farmers Market, Instagram and theultimatehuman.com, and uses service providers such as Klaviyo. We do not control those sites or services and are not responsible for their content, availability or practices. Their own terms and privacy policies apply when you use them.
Disclaimer of warranties
The Site is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we do not warrant that the Site will be uninterrupted, error-free or secure.
Limitation of liability
To the fullest extent permitted by law, Ultimate Brew, LLC and its affiliates, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, goodwill or profits, arising from your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred US dollars ($100). Some jurisdictions do not allow these limitations, so they may not apply to you.
Indemnity
You agree to indemnify and hold us harmless from claims, losses and expenses, including reasonable attorneys' fees, arising from your breach of these Terms or misuse of the Site.
Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. Any dispute will be brought exclusively in the state or federal courts located in Kent County, Delaware, and you consent to their jurisdiction.
Changes
We may update these Terms at any time by posting a revised version with a new effective date. Continued use of the Site after a change means you accept the revised Terms.
